What Laws Protect Against Sexual Orientation & Gender Identity Discrimination?
In Iowa, workers are protected from gender and sexual orientation discrimination under the Iowa Civil Rights Act, codified in Chapter 216 of the Iowa Code. This law prohibits discrimination in employment based on sex, sexual orientation, and gender identity, among other protected characteristics.
In Minnesota, the Minnesota Human Rights Act (MHRA) protects against workplace discrimination based on sex, gender identity, and sexual orientation. The Minnesota Department of Human Rights enforces this state law, prohibiting discrimination in various areas, including employment, housing, and public accommodations.
Title VII of the Civil Rights Act of 1964 is a federal law that protects workers from gender and sexual orientation discrimination. This law prohibits employment discrimination based on race, color, religion, sex, and national origin.
In 2020, a U.S. Supreme Court decision expanded the interpretation of “sex” under Title VII to include sexual orientation and gender identity. It is illegal for employers to discriminate against employees or job applicants based on these characteristics.
Title VII applies to employers with 15 or more employees, including federal, state, and local governments. It covers various aspects of employment, including hiring, firing, promotions, harassment, training, wages, and benefits. The Equal Employment Opportunity Commission (EEOC) enforces the law, which investigates complaints and can take legal action against employers who violate these protections.
